Welcome to Birdr. By accessing or using the Birdr website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
Birdr ("we," "us," or "our") reserves the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.
To access certain features, you must create an account using an email address or a third-party sign-in provider (Google or Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@birdrapp.com if you suspect unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where possible.

You retain ownership of all content you submit to the Service, including sighting data, photographs, audio recordings, notes, and community posts ("User Content"). By submitting User Content, you grant Birdr a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content solely for the purpose of operating and improving the Service.
You represent that you have the right to submit any User Content you provide and that your content does not infringe the intellectual property rights of any third party. We may remove User Content that we believe violates these Terms or that is otherwise objectionable.
Birdr offers an optional paid subscription ("Birdr Pro") that unlocks additional features. By subscribing, you agree to the following:
The Service integrates with and displays data from third-party sources, including eBird (Cornell Lab of Ornithology), xeno-canto, and Wikipedia. This data is provided for informational purposes and is subject to the terms and licenses of those third parties. We do not guarantee the accuracy, completeness, or reliability of third-party data.
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites.
The Service, including its design, code, branding, logos, and original content (excluding User Content and third-party data), is owned by Birdr and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any bird identification suggestions (including AI-powered photo or audio identification) will be accurate. Bird identification results are provided as suggestions only and should not be relied upon as definitive identifications.
To the maximum extent permitted by applicable law, Birdr and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service, regardless of the theory of liability.
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.
You agree to indemnify, defend, and hold harmless Birdr and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.
You may delete your account at any time through the Settings page in the app, or by emailing support@birdrapp.com. Upon deletion, we will remove your personal data within 30 days in accordance with our Privacy Policy. Anonymized or aggregated data that cannot identify you may be retained for analytical and conservation research purposes.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which Birdr operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.
